This Indenture made this thirty first day of July in the year eighteen hundred and forty between John Parkes Senr & Polly his wife of Somerset County and State of Maryland of the one part and James H. Hoffman of the county and State afsd of the other part witnesseth, that for and in consideration of the sum of six hundred dollars current money by the sd. Hoffman to the sd Parkes & wife in hand paid at and before the sealing and delivery of these presents the receipt of which he the said Parkes & wife doth hereby acknowledge the sd Parkes & wife haith bargained and sold aliened and enfeofed and by these presents doth give, grant, bargain alien enfeoff, release and confirm unto the sd Hoffman, all his right and title and interest of an into all his lands which hi has not hereto fore sold off situated and being on Smiths Island joining the land of Elijah Evans known by the name of Hog Neck together with all and singular the building improvements ways waters and water courses, rights member privileges advantages and appurtenances thereto belonging or in any wise appertaining and all the estate, right title, and interest, trust property claim & demands whatsoever at law or in equity of him the said John Parkes Senr. for themselves their heirs & assigns, executors & admrst. doth covenant promise grant, and agree to and with the sd Hoffman that they the said Parkes & wife, their heirs and assigns, the said lands and premises above described therein mentioned to be granted and sold, with the appurtenances unto the said Hoffman his heirs and assigns, shall and will warrant and forever defend by these presents against the claims of all persons whomsoever. In testimony where of the sd John Parkes & wife have hereunto set their hand and seal the day and year first above written

State of Maryland Somerset County towit: Be it remembered that on this thirty first day July A.D. 1840 before the Subscribers two Justices of the peace of the State of Maryland in and for Somerset County personally appears John Parkes, being known to us to be the person whos named and described as professing to be a party to the foregoing deed or indenture and doth acknowledge the sd indenture or instrument of writing to be his act and deed, and at the same time personally appears Polly Parks his wife, before us the subscribers two of the afsd Justices, she being known to us to be the person whos named & professing to be a party to the foregoing deed and being being by us privately examined out of the hearing of her husband whether she made her acknowledgment freely & willingly and acknowledged the lands and premises to be the right title and estate of James Hoffman his heirs and assigns forever. In testimony whereof we hereunto subscribe our names on the day & year aforesaid.

August the 4th day Anno Domini 1840. Then was delivered into me the subscriber the foregoing deed in order to be enrolled among the records of Somerset County, which said deed together with the acknowledgment thereof thereon endorsed is according ly enrolled among the same records in Liber LH folio 378 on the day and year aforesaid
