This Indenture made the Second day of October Anno Domini one thousand and seventeen hundred and twenty one Between Bennet Scarburgh of Accomack county in the Collony of Virginia Gent one of the sons of Charles Scarburgh Decd by Elizabeth his wife now lately decd who was the daughter of Major Richard Bennett of Nansman River in Virginia also deced and Temperance his wife and Henry Scarburgh of the said County of Accomack Gent another of the Sons of the said Charles & Elizabeth and Winnifred his wife and Mary Leatherbury of the County of Accomack widow one of the Daughters and John Bagwell and Tabitha his wife a mother of the and William Black of the said County [-----] and Sarah his wife another of the Daughters of the said Charles & Elizabeth and Scarburgh Drummond Son and heir of Elizabeth who was the wife of Capt Richard Drummond now both lately decd another of the Daughters and George Parker Junior Son and heir of Ann Lately decd who was the wife of George Parker another Daughter of Said Charles and Elizabeth and Elizabeth his wife of the one part and George Dashiell of Somerset County in the provence of Maryland Gent of the other part. Whereas the aforesaid Bennet and Hnery Scarburgh Mary Leatherbury Tabitha Bagwell Sarah Black Scarburgh Drummond and George Parker now are and Stand Lawfully Seized in their demesne as of fee on in and unto a certain tract or parcel of Land called Bennetts Adventure lying and being on the North side of Wiccocomoco Creek Beginning at a marked pine Dividing from the land of Richard Stevens and from thence Running East South East the breadth of Seven hundred and fiftie poles to a marked pine Standing by Wiccocomoco Bridge from thence runing along upon the South side of a Creek called by the Indians Pattindicks the length of four hundred and thirty four poles to a marked Oak Standing at the head of the aforesaid Creek called Pattindicks from thence runing West North West the breadth of Seven hundred and fiftie poles to a marked pine Dividing it from the Land of Richard Stevens with a line drawn South South West to the first bounder containing and laid out for two thousand five hundred acres more or less Which said tract or parcell of Land was by the Honeble Charles Calvert Esq Lieutent General of the province of Maryland in the name of his Father the decd the right Honourable Cecilius Calvert absolute Lord and Prorietary of the said province of Maryland and Avalon Lord Barron of Baltimore by his patent bearing date the Eleventh day of July Anno Domini One Thousand Six hundred Sixty five granted and Confirmed unto the above named Maj Richard Bennett by the Richard Bennett Senr To hold to him his heirs and assigns for ever by the said patent more at large appears which said Richard Bennett in his life time by his last will and Testament bearing date the fifteenth day of March One thousand Six hundred Seventy four amongst other things therein Contained did give and bequeath unto the above said Elizabeth Ann and Bennet his grandchildren or any other of his Daughter Scarborough's children which should be then afterwards born all and singular the aforesaid two thousand five hundred acres of land to them or either of them their or Either of their heirs for ever which Sd Henry Mary Tabitha and Sarah were born after after the making of the afsd bequest and devise as afsd by reason whereof the Sd Henry Mary Tabitha and Sarah together with the aforesadi Scarburgh Drummond as Son and heir of the aforesaid decd Elizabeth and George Parker Junior as Son and heir of the afsd deced Ann and the aforsaid Bennet Scarburgh are and Stand jointly possessed in the demesne of fee of in and unto the afsaid two thousand five hundred acres of Land Now This Indenture Witness that the Sd Bennet Scarburgh Henry Scarburgh Mary Leatherbury John Bagwell and Tabitha his wife Wm Black and Sarah his wife Scarburgh Drummond and George Parker Junr for and in Consideration of the full and Just Sume of three hundred and fifty pounds Curstancy of Virginia to them in hand paid by the afsd George Dashiell before the Ensealing and Delivery of these presents to the receipt whereof they do hereby acknowledge and thereof and of every part and parcell thereof do acquire Execute and Discharge the Said George Dashiell his heirs Exrs Admins and assigns for ever by these presents have granted bargained Sold Aliened Enfeoffed and Confirmed and by these presents for themselves their heirs Executors and Admins do Grant bargain Sell alien Enfeoffe and Confirme unto the said George Dashiell his heirs and assigns for ever all and singular their Several shares or parts to them belonging of in and unto the afsd tract or parcell of land Containing two thousand five hundred acres more or less as above butted and bounded Together with all and singular the buildings ffences Orchards Gardens Woods underwoods Meadows Swamps Marshes Ways Waters Water Courses priviledges [-----] Heredetments and appurtenances whatsoever the same belonging or in anywise appurtaining and the reversions and Resecessions remainder and remainders rents Issues and profits thereof and every part and parcell thereof and all patents and Evidences Concerning the Same To Have and To Hold all and Singular the aforesd Several Shares and parts Containing the aforsd two thousand five hundred acres of land more or less and premises hereby granted with all the appurtenances unto the said George Dashiell and his heirs to the only proper use and behoofe of the said George Dashiell his heirs and Assigns for ever under the yearly Quit rents these [-----] [-----] to the Lord of the ffee thereof and the aforesd Bennet Scarburgh One full Seventh part of the afsd two thousand five hundred acres and premises hereby granted with the appertenances into seven equall parts to be divided and his heirs free and Clear from all Imcumberances (the Quit rents hereafter to become due to the Lord of the fee thereof only Excepted) unto the said George Dashiell his heirs or any of them shall and will warrant and for ever defend by these presents And the sd Henry Scarburgh and his heirs one full seventh part of the aforesd two thousand five hundred Acres of land more or less and premises hereby granted with the appertenances hereby granted into Seven equall parts to be divided free and Clear from all Imcumberances (the Quit rents hereafter to become due to the Lord of the fee thereof only Excepted) Unto the said George Dashiell his heirs and assigns against his the said Henry Scarburgh and his heirs and against all other person or persons Claiming or to Claime by from or under him or them or by from or under the aforesaid Richard Bennett deced and his heirs or any of them shall and will warrant and for ever defend by these presents And the afsd Mary Leatherbury and her heirs one full seventh part of the afsd two thousand five hundred acres of Land into Seven equall parts to be divided more or Less said premises hereby granted with the appertenances free and Clear from all Incumbrances the Quit rents hereafter to become due to the Lord of the fee thereof only Excepted unto the said George Dashiell his heirs and assigns against her the said Mary Leatherbury and his heirs and against all other person or persons Claiming or to Claime by from or George Dashiell his heirs and against all other person or persons Claiming or to Claime by for or under him or them or by from or under the afsaid Richard Bennett deced and his heirs or any of them Shall and will warrant and for ever defend by these presents And the said Bennet Scarburgh Henry Scarburgh Mary Leatherbury Scarburgh Drummond and George Parker Junr Severally for themselves and their Severall heirs Executors and Adms and the said John Bagwell for Himself and Tabitha his wife Wm Black and Sarah his wife Severally and their Severall heirs Exes and Administrators and all other person or persons claiming or to claime by from or under the afsd Richard Bennett deced and his heirs or assigns Shall and will at any time hereafter within the sprie and terme of Seven years next Ensueing from the day of the the Date of these presents unpon the reasonable request Cost and Charges in Law of him the said George Dashiell his heirs or assigns Seale and Execute or cause to be all and every such further and other reasonable [-----] acts deeds Conveyances or assurances in the Law for the further assuring and confirming of the Land and premises hereby granted with the appurtenances unto the said George Dashiell his heirs and assigns at by him or them or by his or their Council learned in the Law Shall be reasonally adivised divised or required provided that the [-----] do not Confirm them or any of them severally warrant and defend otherwise that is [-----] these presents Expressed and the above named Temperance the wife of the above named Bennett Scarburgh and Winifred the wife of the above named Henry Scarburgh and Elizth the wife of the above named George Parker Junr Severally of their own free and Voluntary will and Consent do hereby remit release and for ever Quit Claime unto the said George Dashiell his heirs and assigns for ever their Severall Claymes Rights and Title of Dower of in and unto the Land and premises hereby granted or any part or parcell thereof And premises with the appurtenances to the same belonging In Witness whereof the Severall partied above named to the present Indenture thier hands and Seales Severally and Interchangeably have put dated the Day and Year first above written

Be it remembered that on the Twentie first day of November anno Domini one Thousand Seven hundred and twenty one personally appeared here in Colt a certain Robt Martin of the said County Gent which was authorized by an Instrument of writeing or letter of attorney from the written named Bennet Scarburgh Henry Scarburgh and Winifred his wife Mary Lettierbury Widow William Black and Sarah his wife John Bagwell and Tabitha his wife Scarburgh Drummond and George Parker parties to the within Instrument of writing of Sale or deed of Sale to acknowledge and make over in Open Court unto the within named George Dashiell the within instrument or writeing or Sale and the Land and premises and what therein is Contained according to the true [-----] and meaning of the Said Deed and did them and there before the Worshipfull Judge and Other his associates Justices of the Same Colt Judicially Sitting acknowledge the within Instrument of writeing or deed of Sale and the Land and premises and what therein is Contained unto the Said George Dashiell his heirs and Assigns for ever according to the true Intent and meaning of the Said deed
